Issues: (1) Whether the Health Insurance Portability and Accountability Act, along with other state and federal regulations, provides the basis for an individual's reasonable expectation of privacy in his medical records sufficient to invoke Fourth Amendment protections; and (2) whether HIPAA preempts Texas's law that a prosecutor may independently obtain the medical records of a person suspected of committing a crime because there is no reasonable expectation of privacy in those records.
