At 10 a.m., the Court will release the remaining orders from the Justices’ private conference last Friday. Following the release of orders, the Court will hear argument in Coeur Alaska, Inc. v. Southeast Alaska Conservation Council, et al. and Alaska v. Southeast Alaska Conservation Council, et al. (07-984) (07-990), involving the permit process for discharging mining pollutants under the Clean Water Act. Ted Olson of Washington, D.C., will argue for the petitioners, Thomas Waldo of Juneau, Alaska, will argue for the respondents, and Solicitor General Greg Garre will argue for the federal respondents in support of the petitioner.
At 11 a.m., the Court will hear argument in Ministry of Defense and Support for the Armed Forces of the Islamic Republic of Iran v. Elahi (07-615), involving an attempt to recover money from Iran over an alleged assassination by members of the Iranian government. David Bederman of Atlanta will argue for the petitioner, Carter Phillips of Washington, D.C., will argue for the respondent, and Douglas Hallward-Driemeier of the Solicitor General’s office will argue as amicus curiae for the United States.
At 1 p.m., the Court will hear argument in Harbison v. Bell (07-8521), involving the right of prisoners to have federally funded counsel during state clemency proceedings. Dana Hasen of the Knoxville, Tenn., defender’s office will argue for the petitioner, and William Jay of the Solicitor General’s office will argue as amicus curiae in support of the judgment below.
