Today at the Supreme Court | 11.5.08

At 10 a.m., the Court will hear argument in Negusie v. Mukasey (07-499), on whether the provision of the Immigration and Naturalization Act that prohibits granting asylum to, or withholding of removal of, individuals that themselves engaged in persecution applies to those who were compelled to do so by threats of deaths or torture. Andrew Pincus of Washington, D.C., will argue for the petitioner, and Assistant Attorney General Gregory Katsas will argue for the respondent.

At 11 a.m., the Court will hear argument in Van de Kamp v. Goldstein (07-854), on whether supervising district attorneys possess absolute immunity against claims they failed to ensure line prosecutors disclosed constitutionally required information to criminal defendants. Timothy Coates of Los Angeles and Deputy Solicitor General Michael Dreeben will argue for the petitioner, and Joshua Rosenkranz of New York will argue for the respondent.
