At 10 a.m., the Court is scheduled to hear argument in Kennedy v. Louisiana (07-343), involving the constitutionality of imposing the death penalty for child rape. Jeffrey L. Fisher of Stanford University will argue for the petitioner, and Louisiana Assistant District Attorney Juliet L. Clark and Texas Solicitor General R. Ted Cruz will argue for the respondent.
At 11 a.m., the Court is scheduled to hear argument in Taylor v. Sturgell (07-371), involving the theory “virtual representation†in civil suits. Adina H. Rosenbaum will argue for the petitioner, Douglas Hallward-Driemeier of the Solicitor General’s office will argue for the respondent Sturgell, and Catherine E. Stetson of Washington, D.C., will argue for the respondent Fairchild Corporation.
