Holding: Federal patent law does not allow an appeal of the Patent Trial and Appeal Board's decision to institute a procedure for challenging the validity of a patent after finding that a one-year time bar does not apply.
Judgment: Vacated and remanded, 7-2, in an opinion by Justice Ginsburg on April 20, 2020. Justices Thomas and Alito joined the majority opinion except as to Part III"C. Justice Gorsuch filed a dissenting opinion, in which Justice Sotomayor joined as to Parts I, II, III and IV.
