Issue: (1) Whether the increasingly rare and geographically isolated practice of imposing the death penalty through override violates the nation's evolving standards of decency and the Eighth Amendment; and (2) whether, when the jury determines that aggravation does not outweigh mitigation, the trial judge's override of that determination based on evidence not considered by the jury violates the defendant's Sixth Amendment right to a jury under Ring v. Arizona.
