Citizen plea denied by Court

The Supreme Court refused on Monday to order a delay in the transfer of a U.S. citizen to Iraqi authorities to carry out a death sentence following a criminal conviction in an Iraqi court. The Court’s unexplained order can be found here. Mohammad Munaf is still awaiting word on whether any relief will be provided by the D.C. Circuit Court. If that Court also refuses to reconsider en banc the action of one of its panels rejecting Munaf’s plea, he could be handed over as soon as an appeal in Iraqi courts is resolved. He is now in custody at a military air base in Baghdad.

The application in Mohammed v. Harvey (06A471) was originally filed with Chief Justice John G. Roberts, Jr., as Circuit Justice. He referred it for action to the full Court. (The application was filed by Munaf’s sister, whose last name is Mohammed, with an “e.”).
