State of the Firm

Every once in a while we do a short post on the cases the firm is working on at the Supreme Court.

We are currently counsel in four cases on the merits for next Term:
No. 04-66, Tum v. Barber Foods (to be argued in October) involves employees’ right to compensation for the time they spend walking to and waiting at clothes-changing stations. We represent the plaintiff-petitioners.
No. 04-1067, Georgia v. Randolph (to be argued in November) involves the lawfulness of a search when one occupant of a house consents but the other objects. We represent the defendant-respondent.
No. 04-1131, Whitman v. Department of Transportation (to be argued in December or January by Pam Karlan) presents questions relating to the right of federal employees to bring claims arising out of their employment directly in federal court. We represent the plaintiff-petitioner.
No. 04-1559, Bank of China v. NBM LLC (to be argued in December or January) presents the question whether RICO plaintiffs alleging mail or wire fraud as predicate acts must prove reliance. We represent the defendant-respondents.

At the cert. stage, the firm represents the petitioners in three petitions that have been filed and the respondent in one brief in opposition that has been filed. We have five petitions in progress (and two other cases we are evaluating), as well as a brief in opposition and a cert. amicus brief in progress.
