Upcoming Arguments: Gall v. United States and Kimbrough v. United States

Today at 10 a.m., the Court is scheduled to hear oral argument in Gall v. United States (06-7949), asking whether district courts must justify a downward departure from the U.S. Sentencing Guidelines under United States v. Booker (2005). Jeffrey T. Green of Washington, D.C., will argue the case for the petitioner and Michael Dreeben of the Solicitor General’s office will argue for the respondent. At 11 a.m., the Court will hear argument in Kimbrough v. United States (06-6330), asking whether district courts may depart from the 100:1 sentencing ratio between crimes involving crack and powder cocaine. Michael S. Nachmanoff of the E.D. Va.’s Federal Public Defender’s Office will argue for the petitioner, and Dreeben will argue for the respondent.
