Court-related coverage and commentary are dominated by Friday’s announcement that the Court will review the challenges by several religious non-profits to the Affordable Care Act’s birth-control mandate. Lyle Denniston covered the grant for this blog, with other coverage coming from Mark Walsh at Education Week’s School Law Blog (registration may be required) and NPR’s Nina Totenberg. Commentary on the cases and the grant comes from Marty Lederman at Balkinization, Gregory Lipper at the Bill of Health Blog, Leland Beck at the Federal Regulations Advisor, Carrie Severino at Bench Memos, and Lyle Denniston at Constitution Daily.
The November sitting resumes today, with oral arguments in the ERISA case Montanile v. Board of Trustees of the National Elevator Industry Health Benefit Plan. Ronald Mann previewed the case for this blog, while Ben Rosales and Thomas Kim do the same for Cornell’s Legal Information Institute.
On Tuesday the Court will hear oral arguments in Tyson Foods v. Bouaphakeo, which Lyle Denniston previewed for this blog. Commentary comes from Karen Harned at the Fed Soc Blog.
Commentary on last week’s oral arguments continues as well. Lyle Denniston discusses Spokeo, Inc. v. Robins at Constitution Daily, while Jonathan Keim does the same at Bench Memos. Commentary on Lockhart v. United States comes from Noah Feldman at Bloomberg View, Marci Hamilton at Hamilton and Griffin on Rights, Steven Mazie for The Economist, and Asher Steinberg at The Narrowest Grounds. Steinberg also weighs in on last week’s oral arguments in Torres v. Lynch in a second post.
