Today at the Court: December 5, 2011

At 10:00 this morning we expect the Court to issue orders from the December 2 Conference. Our list of “Petitions to watch” for that Conference is here. We do not expect any opinions in argued cases this week.
The first argument today is in Caraco Pharmaceutical Laboratories v. Novo Nordisk, in which the Court will consider the Hatch-Waxman Act and the scope of patent protection for a generic drug. Ronald Mann previewed the case for us.
The second case to be argued today is Messerschmidt v. Millender, in which the Court will consider police immunity for carrying out an overbroad search warrant. Michael Smith previewed the case for us, and Orin Kerr provided additional background and analysis.
