Briefly:
- In The New York Times, Adam Liptak covers recent remarks by Justice Elena Kagan in New York City, as part of an annual lecture in honor of Justice Ruth Bader Ginsburg.
- At The Volokh Conspiracy, Will Baude analyzes the validity of a new Supreme Court Rule, Rule 28.8, which prohibits non-lawyers from arguing at the Court. Baude suggests that the rule may conflict with a federal statute which provides that, “in all courts of the United States the parties may plead and conduct their own cases personally or by counsel.”
