Age bias case dismissed

In a one-sentence order, the Supreme Court on Tuesday dismissed the case of Madigan v. Levin, in which it had heard oral argument on the opening day of the Term last week.  The case was cast aside as “improvidently granted.”  It was a test of the remedy that would apply to age bias claims by public employees.

Although the Court does not explain the kind of order it issued to take this case off of its docket, the problems that had developed in the case had become apparent at oral argument.  The blog analyzed that argument in this post.
