The Court issued one opinion this morning:
Virginia Office for Protection and Advocacy v. Stewart  (No. 09-529): By a vote of six to two, the Court reversed the decision of the Fourth Circuit. The Court held that its decision in Ex Parte Young allows a federal court to hear a lawsuit for prospective relief against state officials brought by another agency of the same state. Justice Scalia wrote the opinion for the Court. The Chief Justice filed a dissenting opinion, which was joined by Justice Alito. Justice Kennedy filed a concurring opinion, which was joined by Justice Thomas. Justice Kagan did not participate in the case. The Court’s opinion is here.
