Details on this morning’s orders

This morning, the Court issued orders from its April 15 Conference,.  It granted cert. in one case, Judulang v. Holder (No. 10-694). It denied certiorari in Kiyemba v. Obama, in which five Chinese Uighurs held in Guantanamo Bay had asked the Court to review whether federal judges have the power to order the release from confinement of a detainee who was being held unlawfully. Justice Breyer issued a statement respecting the denial that was joined by Justices Kennedy, Ginsburg, and Sotomayor; Justice Elena Kagan did not participate in the case.  The Court took no action on Virginia v. Sebelius, the challenge to the Affordable Care Act.

 The Court has also invited the Acting Solicitor General to file a brief expressing the views of the United States in Compton School District v. Addison (case page forthcoming).  The full order list is here.

Issue(s): Whether a lawful permanent resident who was convicted by guilty plea of an offense that renders him deportable and excludable under differently phrased statutory subsections, but who did not depart and reenter the United States between his conviction and the commencement of removal proceedings, is categorically foreclosed from seeking discretionary relief from removal under former Section 212(c) of the Immigration and Nationality Act.
