As Lyle reported yesterday, Virginia Attorney General Ken Cuccinelli has announced that he plans to seek Supreme Court review of the constitutionality of the new federal health-care law, without waiting for the Fourth Circuit to act on the issue. The Justice Department issued a statement  indicating that it did not agree that expedited review was warranted. The Justice Department reasoned, among other things, that because the case “is one of two that are already scheduled for argument in the Fourth Circuit this May, . . . going through the usual process would make little difference in timing as to when the Supreme Court could hear it.†Bloomberg News, the New York Times, the Washington Post, the Wall Street Journal and the Richmond Times-Dispatch all have coverage of these latest developments.
During the Court’s recess, some Justices are busy with travel and public appearances. The Contra Costa Times reports that Justice Sotomayor’s recent appearance as a moot court judge at UC Berkeley drew over two thousand spectators. Earlier in the day, Justice Sotomayor paid a surprise visit to Rosa Parks Elementary.
