Response requested in Burris case

Justice Stephen Breyer, the circuit justice for the Seventh Circuit, has called for a response in Burris v. Judge (10A272), in which Illinois Senator Roland W. Burris is seeking a stay of a federal judge’s order that will keep his name off the ballot in November’s election to fill the two months remaining in his term. Lyle covered Burris’s application for a stay in detail when it was filed last week. The response to the application is due by noon Eastern on September 20. (Many thanks to Rick Hasen for alerting us to this new development.)
