This morning at 10 a.m., the Court will hear oral argument in Stop the Beach Renourishment, Inc. v. Florida Department of Environmental Protection (08-1151), which asks whether a judicial decision declaring shoreline newly exposed by a state program to be public property can constitute a “taking” of property. Elisabeth Oppenheimer of Stanford Law School previewed the case earlier on SCOTUSblog.
