Today at the Court

At 10 a.m., the Court may issue one or more opinions in pending cases. We will provide coverage of any developments.

Following the announcement of any rulings, the Court will hear argument in Caperton v. A.T. Massey Coal Company, Inc., et al. (08-22), questioning the duty of an elected West Virginia judge to disqualify from a case in which a major campaign donor has an interest. Ted Olson of Gibson, Dunn & Crutcher in Washington, DC will argue for Hugh Caperton and the Harman group of companies.  Andrew L. Frey of Mayer Brown in New York will argue for the Massey company.

At 11 a.m., the Court will hear argument in Arthur Andersen LLP, et al. v. Carlisle, et al. (08-146), involving the right to appeal a District Court’s refusal to stay a pending case during arbitration. M. Miller Baker of McDermott Will & Emery in Washington, DC will argue for the petitioners. Paul M. De Marco of Waite, Schneider, Bayless & Chesley Co. will argue for the respondents, the owners of a construction equipment business.
