No oral arguments are scheduled this week. No merits briefs for petitioners or respondents are due this week.
On Monday, the Court is expected to release opinions in pending cases and orders from the Justices’ private conference last Friday.
On Thursday, the Obama Administration is to file in the D.C. Circuit Court its views on whether former detainees may sue U.S. officials over claims that they were tortured while being held at Guantanamo Bay — a case on remand from the Supreme Court, Rasul v. Rumsfeld (Supreme Court Docket 08-235, Circuit Docket 06-5209).
On Friday, the Obama Administration is to file, in several Guantanamo detainee cases in U.S. District Court, its views on who is to be designated an “enemy combatant” and thus must be confined as a prisoner.
