Supplemental briefing ordered in Dada

The Supreme Court this afternoon ordered the parties in Dada v. Mukasey (06-1181) to file supplemental briefs on the following question:

“Whether an alien who has been granted voluntary departure and has filed a timely motion to reopen should be permitted to withdraw the request for voluntary departure prior the the expiration of the departure period.”

The briefs are to be filed simultaneously before 2 p.m. on January 25. Reply briefs, if any, are due by 2 p.m. on February 1. A copy of the order is available here.
