Interesting Reactions to the Rumsfeld v. FAIR Decision

Well worth reading are reactions to the Solomon Amendment decision from Dale Carpenter (who looks more carefully than I did at some of the doctrinal intracacies, including the implications for the “expressive association” right recognized in Dale) and from David Barron (who focuses on the Chief Justice’s modes of constitutional decisionmaking — and those he has thus far eschewed).
