The Supreme Court last week refused to grant cert in a closely watched DMCA case involving a claim for more than $100 million in damages, Lexmark v. Static Controls, but as this article from Business Week explains that wasn’t necessarily because the petition lacked merit: it was filed out of time and apparently never docketed. (Thanks to the reader who called the case to our attention.)
