Raich — Scalian Apoplexy (or Apostasy)

No, this time the apoplexy comes not from Justice Scalia’s own sharp pen in dissent, but is instead pointed in his direction from many self-styled originalists, textualists and libertarians in the blogosphere who are prepared to excommunicate AS from the School of True Believers. (In fairness, some of the posts are not apoplectic, but instead reflect a tone of disappointed resignation.)
For among the more thoughtful examples, see, for instance, this post from “Cato X” at Ex Post; and this post from Crime & Federalism, in which Mike S. concludes that “[s]adly, there is only one Supreme Court Justice with a chest.” And even over at Ninomania itself, David Wagner despairs that their “hero” has gone soft: “Now, it’s one thing to accept the Shreveport Rates doctrine that a proper federal regulatory scheme may reach intrastate economic activity, but another, imho, to accept supinely the New Deal add-on to Shreveport, as Our Hero does.” No word yet on whether the name of the blog will soon be changed to “Clarencemania.”
