Leading Cases By Public Interest

The Court has decided 48 argued cases from the Term and has 26 remaining. Here is the status of the cases that are — in my view, and others would certainly compile a different list — the fifteen leading decisions of the Term based on the public and press interest surrounding the cases, as opposed to their jurisprudential significance. They are listed here in the order they were argued, with * denoting my top five:

Decided cases
*Booker/Fanfan – Sentencing
*Roper – Juvenile executions
Caballes – Drug dogs
City of Jackson – Age discrimination
Swedenburg – Wine importation
Cutter – Religion in prisons
Medellin – Execution of foreign nationals
Arthur Andersen – Obstruction of justice

Pending cases
*Raich – Medical marijuana
Kelo – Takings
Spector – Disabled on cruise ships
*Van Orden / McCreary County – Ten Commandments
Castle Rock – Protective orders
*Grokster – File sharing
Brand X – Internet access
