One of the interesting petitions up for consideration on May 12 is No. 04-1055, Safe Air for Everyone v. Meyer, a RCRA case dealing with the definition of “solid waste” in which Richard Lazarus of Georgetown Law School is lead counsel to the petitioner. Here are the petition, opposition, and reply. Amicus briefs in support of cert. have been filed by the American Lung Association and Idaho Medical Association.
