March Hearing List — and Grokster briefs

The Court has released the list of attorneys who will be presenting oral arguments in the nine arguments over the next two weeks. Acting SG Paul Clement will be arguing twice — this coming Monday, in No. 03-9877, Cutter v. Wilkinson, for 20 minutes on behalf of the U.S. as a respondent in support of the petitioners, defending the constitutionality of the Religious Land Use and Institutionalized Persons Act of 2000; and on the following Tuesday, March 29th, in the Grokster case (No. 04-480), for the U.S. as amicus in support of the petitioners, arguing that providers of “file sharing” network software can be secondarily liable for copyright infringement if the vast majority of uses of the providers’ networks constitute
copyright infringement.
