We filed this reply brief today in No. 03-1388, Spector v. Norwegian Cruise Line Ltd. At issue in the case is whether and to what extent Title III of the Americans With Disabilities Act applies to companies that operate foreign-flagged cruise ships in U.S. waters. The case will be argued next Monday, February 28. Goldstein & Howe’s own Tom Goldstein will argue for the petitioners, sharing his time with Assistant to the Solicitor General David Salmons, who will argue on behalf of the U.S. in support of petitioners. Kellogg Huber’s David Frederick will argue on Norwegian’s behalf; The Bahamas — whose motion to participate in oral argument as an amicus was granted today — will in all likelihood be represented by Greg Garre of Hogan & Hartson. This is the fourth case that we’ve done on the merits with our colleague Pam Karlan and the students of the Stanford Law School Supreme Court Litigation Clinic.
