The Court has released two opinions today.
The Court has released the opinion in Bobby v. Bies (08-598), on double jeopardy protections in post-conviction hearings on an inmate’s mental competency. The decision below, which held for the capital defendant, is reversed and remanded in a unanimous opinion by Justice Ginsburg, available here.
The Court has released a per curiam opinion in CSX Transportation v. Hensley (08-1034). The decision below, which held for the employee, is reversed and remanded. Justice Stevens filed a dissenting opinion and Justice Ginsburg filed a dissenting opinion. The opinion is available here.
