Details on today’s orders and opinion

This morning, the Court issued orders from its April 29 Conference. The Court has granted two cases, CompuCredit v. Greenwood and M.B.Z. v. Clinton. In addition to the question presented in the latter case, the parties have been asked to brief and argue whether Section 214 of the Foreign Relations Authorization Act, Fiscal Year 2003, impermissibly infringes on the President’s power to recognize foreign sovereigns. The Court also issued one opinion and one summary reversal today. The opinion in Montana v. Wyoming was written for the Court by Justice Thomas. By a vote of seven to one, the Court held that Montana’s claim against Wyoming fails to state a claim for breach of the Yellowstone River Compact. Justice Scalia dissented alone. Justice Kagan was recused. The opinion is here.  And in Bobby v. Mitts, the Court summarily reversed a decision of the Sixth Circuit ruling in favor of a death-row inmate in a per curiam opinion, which is available here.
